Terms & Conditions

Thank you for doing business with Motivation by Mail LLC. By subscribing to our motivational postcard service, you agree to be bound by the following terms and conditions. Please read them carefully.

1. Subscription service

  • The Service: We offer a subscription service for motivational postcards. Based on your selected plan, we will send one weekly postcards to the recipient at the mailing address you provide. 

  • Postcard Content: The content of the postcards is predetermined by our service. While we strive to provide uplifting and inspiring messages, the aesthetic and specific message of each card is at our sole discretion.  Cards may include Christian sentiment and/or biblical reference, unless the customer specifies the exclusion of religious content when ordering.

  • Delivery: Postcards are mailed on a weekly basis to the address you provide at the time your order is placed. We are not responsible for delivery delays caused by the postal service or for postcards lost in transit. 

  • Change in Service:  Should you need to change the address for an ongoing subscription, please contact our Customer Service team.

2. Account and membership

  • Account Registration: To subscribe, you must provide accurate and complete registration information. 

  • Eligibility: The service is intended for users who are at least 18 years of age. By using the service, you represent that you meet this age requirement.

  • Restrictions on Use: You may not use the service for any illegal or unauthorized purpose. You agree not to send unsolicited communications, such as spam, to our service or through our platform. 

3. Payment and billing

  • Billing: Your subscription will be billed the day you initially signed up.

  • Price Changes: We reserve the right to change our subscription prices at any time. We will provide you with reasonable advance notice of any price changes via the email address associated with your account.

  • Failed Payments: If we are unable to process your payment, we may suspend or cancel your subscription until payment is successfully processed.

4. Cancellation and refunds

  • Cancellation Policy: You may cancel your subscription at any time by contacting our Customer Service team.

  • Non-Refundable Fees: All subscription fees are non-refundable. We do not provide refunds or credits for partially used subscription periods.

5. User-provided information

  • Mailing Address: You are solely responsible for the accuracy of the recipient's mailing address you provide. We are not responsible for subscriptions mailed to an incorrect address provided by you.

  • Third-Party Information: If you are providing a mailing address for someone other than yourself, you represent and warrant that you have obtained their consent to provide their personal information to us. 

6. Intellectual property

  • Our Content: All content on our website and the designs on our postcards, including text, graphics, and logos, are our property and are protected by intellectual property laws.

  • Limited License: You are granted a limited, non-exclusive, non-transferable license to use our services and content for personal use only. You may not resell, reproduce, or distribute our products or content without our express written permission. 

7. Limitation of liability and disclaimer of warranties

  • "As Is" Service: The service is provided on an "as-is" and "as-available" basis without any warranties, express or implied. While we will make every effort to fulfill our service agreement, we do not guarantee that the service will be uninterrupted or error free.

  • Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use of or inability to use the service. 

8. Indemnification

  • You agree to indemnify, defend, and hold us harmless from any claims, losses, damages, or expenses (including attorneys' fees) arising from your use of the service or your violation of these terms. 

9. Governing law and dispute resolution

  • Governing Law: These terms shall be governed by and construed in accordance with the laws of the State of New York, USA.

  • Dispute Resolution: In the event of a dispute, you agree to first attempt to resolve it informally by contacting us. If a resolution is not reached, any legal action will be brought in the courts of the state of New York, USA.

10. Changes to terms and conditions

  • We reserve the right to modify these terms and conditions at any time. We will provide notice of any material changes by updating the "Last Updated" date at the top of this page. Your continued use of the service after such changes constitutes your acceptance of the new terms.
